Apple has been dealt another blowin China, after a Beijing court ruled that it cannot prevent the iPhone namebeing used on certain leather accessories sold in the country by anothercompany.

苹果(Apple)在中国受到又一次打击,北京一家法院裁定,它不能阻止另一家公司在中国销售的某些皮具配饰上使用iPhone名称。

In a lawsuit,the US technology group had sought to stop Xintong Tiandi Technology, a littleknown accessories maker,from using the iPhone trademark on wallets and purses.

此前这家美国科技集团发起诉讼,试图阻止鲜为人知的配饰制造商新通天地科技公司(Xintong Tiandi Technology)在钱包和小皮夹上使用iPhone商标。

But the rulingaffirmed that Xintong has the right to use the iPhone name on its products,according to state publication Legal Daily, because the Chinese company holds aClass 18 trademark covering leather and imitation leather goods, ranging fromsmartphone cases to wallets and clutch bags.

但是,据官方的《法制日报》(LegalDaily)报道,法院裁决确认新通天地公司有权在其产品上使用iPhone名称,因为这家中国企业持有第18类商标,涵盖皮革和仿皮革产品,比如智能手机套子、钱包以及手包。

Apple retains full use of thetrademark on mobile devices, and one trademark lawyer based in China said theruling would not necessarily prevent Apple from selling its own leather goodsbranded with the iPhone name in China.

苹果保留在移动设备上使用这个商标的一切权利,一名在华执业的商标律师还表示,这项裁决不一定会阻止苹果自己在中国销售以iPhone为品牌的皮具。

Nevertheless,the ruling represents the latest in a string of setbacks for Apple in China.

Last month, thecompany’s iTunes films and iBooks services were suspended by Beijing regulators,following new rules governing the publication of internet content. Then, lastweek, Apple disclosed its first quarterly revenue decline in 13 years and thefirst fall in iPhone sales, partly because of softening demand in China — once the company’sstrongest growth area. Revenue from China, Taiwan and Hong Kong fell 26 percent, year on year, in Apple’s second quarter.

Carl Icahn, the veteran investor, alsocited concerns about Beijing’s attitude towards Apple when announcing that hehad sold his stake in the company last week. He said that Beijing could “come in andmake it very difficult for Apple to sell there”

Apple said ithad “prevailed in severalother cases against Xintong” and wasdisappointed the Beijing court had chosen to allow the Chinese company to usethe iPhone name.苹果表示,它已在其他数起诉讼中对新通天地胜诉,并对北京法庭选择允许这家中国公司使用iPhone名称表示失望。

We intend to requesta retrial with the Supreme People’s Court and will continue to vigorously protect our trademarkrights,” Apple said.

In the iPhoneaccessories case, a Beijing court upheld a 2013 ruling based on Apple’s failure tobe the first to register the iPhone trademark in China for leather goods.Xintong registered the trademark in September 2007 but iPhones did not go onsale in China until 2009, the ruling said.

This is not aconspiracy against Apple,” said one trademark lawyer based in China, who pointed out thatforeign companies sometimes fail to take adequate precautions to protect theirmarques in China.

“这不是针对苹果的阴谋,”在中国执业的一名商标律师表示。他指出,外国公司有时未能在中国采取充分预防措施来保护自己的品牌。

Lei Yongjian, atrademark counsel at Wan Hui Da Intellectual Property Agency’s Beijingoffice, said: “The other party registered the trademark very early, but accordingto Chinese law, you have to prove you were a well-known brand ahead of theother party’s registration to win such a case.”

万慧达知识产权代理公司(Wan HuiDa Intellectual Property Agency)北京办公室的商标律师雷用剑表示:对方很早就注册了该商标,但根据中国的法律,你必须证明你在对方注册之前就是一个驰名品牌,才能赢得这样的案子。

Being famousglobally is not sufficient to win such a case, unless that fame also extendedwithin China’s borders, the lawyers explained.

不止一名律师解释说,除非知名度延伸至中国境内,否则在全球驰名不足以赢得这类案子。

Apple has faceda similar issue over its iPad trademark. In 2012, Apple paid $60m to ProviewInternational to settle adispute over the right to use the iPad name in China.

苹果在其iPad商标上也曾遇到类似问题。2012年,苹果公司曾支付6000万美元,与唯冠国际(ProviewInternational)了结围绕在中国使用iPad名称的纠纷。
